Interesting that the rear wing isnt meant to be that high unless the key is inserted and it goes into 'super speed mode' , which means speeds over 220km/h , think someone might have been out 'test' driving

Isnt it the other way round?...the spoiler is put down for less drag in super slick mode by turning the key in the slot in the door sill.
I could be wrong.

i think you right with that one mate, less drag(downforce) equals higher top speed

from what i have seen on videos the spoiler is flat until about 250km/h then it pops up to provide stability in the rear, just what ive seen though

It pops up to produce downforce to keep the bitch on the road as it has a flat under belly.
The car's everyday top speed is listed at 350 km/h. When the car reaches 220 km/h, hydraulics lower the car until it has a ground clearance of about 9 cm. At the same time, the wing and spoiler deploy. This is the "handling mode", in which the wing helps provide 3,425 newtons (770 lbf) of downforce, holding the car to the road, and helping the Bugatti Veyron preform 1.34 g forces on a 300 foot skidpad.[16] The driver must, using a special key (the "Top Speed Key"), toggle the lock to the left of his seat in order to attain the maximum (average) speed of 408 km/h. The key functions only when the vehicle is at a stop, when a checklist then establishes whether the car—and its driver—are ready to enable 'top speed' mode. If all systems are go, the rear spoiler retracts, the front air diffusers shut and the ground clearance, normally 12.5 cm, drops to 6.5 cm.

From what i've seen on top gear, if the spoiler is turned off using the key, it will not come back up. Otherwise the veyron will not reach its top speed...

James May's top speed run shows it down all the way to 407km/h after he inserted the key next to the drivers door. He got it to pop up while slowing down by giving the brakes a slight tap, and the the spoiler pops back up as a air brake of sorts and to help keep the ass end stable as it slows.

I reckon the wing is up because the driver had both feet trying to push the brake pedal through the floor trying to pull her up.
Some air brake facts
The Veyron’s brakes are another technological anomaly, using distinctive cross-drilled, turbine-vented carbine rotors, drawing in cooling air to reduce fade. Snapping into place within 0.4 seconds at a 55-degree angle, the rear wing acts as an air-brake. With this innovative technology, Bugatti claims the Veyron will brake from 249 mph to a standstill in less than 10 seconds!
It was a nice straight stretch of road which would have been good until the swim.

Veyron's all about big numbers. The wheels are 10,000 Pounds EACH. Tyres 2,500 Pounds each. So a full set of rims and tyres in 50,000 Pounds. And don't even get started on the indicator/wiper stalks...4,500 Pounds each. DAMN.
