View Full Version : Got summons for unlicensed vehical in wa, advice please

ok, i get on a plane in less than two hours so quick answers would be great.

Just got a letter from the courts for driving my car unlicensed a month ago.

That night i got done for 15ks over the limit, said hed do a rego check and nothing was said, I usually get my mrs to pay my bills and the fact that we got married a close to when the rego was due and being busy doing the wedding we just simply didnt think of it.

Now we are double checking, but rego was payed online either a couple days before or after i got done for speeding.

Short answer is im guilty, but any advise on what to put in my letter to the courts and who knows whats the worst ass kicking i can get from it?

In nsw you get a fine, big fine, few hundred dollars over what it would have originally cost you to register the vehicle.

Worst case scenario you get locked up for months, your wife cheats on you, and you to like having a go on the pogo stick. But i dont think it'll get to that unless you've previously been done for the same thing a few times. :D

Fine & points. In Victoria it is about $500 and 6 points. Not sure in W.A :)

As for quoting web sites that are not state government/ possibly no up to date, best you call the police to find out exactly where you stand coz the law has been changing every five mins in WA it seems

Car only gets confiscated if the DRIVER is unlicensed...not the car.

You will get a fine...between $100 and $150 plus costs (about $100) plus half annual license fee (depends on your car).

NO Points deducted.

NO loss of license.

A VERY VERY minor traffic matter..

I just come out of court for doing a burnout and there was a guy in a very similar situation to you although he had to go over seas for a few weeks.

He said that the registration was paid as soon as he could and it was his belief the car was registered at all times, and that he was extremely busy at the time (whatever reason he said about having to go overseas), and that if that isn't the case he asked leniancy from the court as having no license would have a detrimental effect on his livelihood. He also said that all his registrations have been paid on time, and that it is not of his nature to go against the law and drive an unregistered vehicle knowingly.

The magistrate gave him a fine for $400, and was free to go. No license penalties or anything...

Hows that ? I let my rego renewal slip by one day by accident and I couldn't pay online. I had to ring up and plead my case to the lady on the phone who nicely put it through for me.

As far as I know, you can still pay online for up to 90days after expirey, but you cannot drive it once it is 30 days past renewal as there is no 3rd party.

We have had the odd work vehicle expire by a month or so(when you have about 15 cars, its easy to forget one), and had not probs paying online.

and your right up to date with all the law changes?. I was threatened to have my car confiscrated when l got the yellow sticker.........wait for it.......because the exhaust was too loud. He quoted the new law and said the police can pretty much confiscate your car for almost anything.

And this was after l downloaded what l thought was the latesd law change up date. I was bluntly told by the copper those websites take ages to be updated.

Also when l had my yellow sticker l was told my a government run inspection centre that if the permit runs out (hence it's unregistered) my car can be confiscated without question.

so l'd take whatever is said on this forum as gospel and find out for yourself

wa is pretty lax with rego i reakon. i've let a few of my cars go past renewel date by a month or so as they give you 3 months to pay for it once it expires.

You just cant drive them on the road after 15 days of the expired date as the 3rd party insurance is no longer valid. (not really a problem when the car doesnt leave the back yard).

Car rego is just a tax, nothing more nothing less.

Did they take the No plates of the car if it was unlicensed by memory they are required to take the plates of, I have been late paying mine a few times stupid me but if ya can pay it online you shouldn't have gotten a fine they give you 14 days by memory and then 3 mths after that and then you have to hand the plates in. but after the 14 days you are not covered by 3rd party so I guess anything after that time they could fine you.

I am VERY up to date on the current RTA amendments.:goodjob:

If a copper told you he could seize your car for having a loud exhaust he was trying to scare you. It obviously worked.

If the vehicle examiner told you that the coppers could seize your car for an expired permit then he was talking out his ass.

Go to the State Law Publishers website and look at Section 78A of the RTA 1974 if you are still not convinced.

Wow $500 for unregistered vehicle is very cheap. Someone correct me if im wrong but im sure a mate of mine when i was heaps younger got done for driving an unreg vehicle that wasnt even his and wasnt aware of it and copped a $1400 fine on the spot. No court.

I don't know where ppl are getting the info on the Sub $500 fines......

Its no good mate, but sounds like you will get booked for :
* Speeding 15KPH over I'd hazard a guess around $150 and point loss
* No Vehicle Registration $408-$500
* No 3rd party Insurance $408-$500

Usually, no Registration (and therefore no 3rd party) will see you get little change from $1000 depending on the state so check there first...!

In WA the MAXIMUM is $500. The average in WA (where the OP is from) is about $100 plus court costs...

I got busted years ago (when i was 17) driving my old VH unregistered. The fine was $375, and that was it. He went easy on me though, due to the circumstances (mate was broken down at the park behind my house and we drove the VH there to take tools over, in the middle of the night).

OMR346 - yes I'd believe that. I have been done 3 times unregistered (a car and twice on bike over the years) and first and 2nd time was hammered, 3rd time only got fine for no registration ($408 in ACT) and was not booked for no 3rd party....

This sorta thing is what shits me, at least they could be consistent when they're booking you (esp in same state) but then I no complain on #3.....

Hope it's not too pricey for ya!

I had an accident in my work van (head on) with an old guy that ran a red light totally his fault and the cops called round my home some 2 months later and said my registration had lapsed on the van for nearly 2 years (FARCANAL I thought) My sister is the office manager of our company (6 vehicles) and the copper was right it hadn't been paid for 2 years.

I thought for sure I was gona be bent over at the local prison cells for 6 months but I went to court and explained that if I wasn't involved in the accident I would still be driving around unregistered and it was an office oversight. The magistrate said she believed me and that by law I had to loose my licence so she took it away for 1 day on a Sunday the following week and I had to pay $185 court fees. Now all the vehicles are checked regularly by my sister as I said she would be the one going to court next time !!!!!

3rd party insurance is paid as part of vehicle registration in w.a

we dont have any of the bullshit blue/pink slip stuff going on.

rego is pretty cheap compared to other states too. i.e $420 for 12 months on my vy ute and no rego stickers.

But so it should be, with the amount of tax the government collects from mining.

Try buying a car off a family friends dealership and thinking it had close to 12 months rego.
Bought the car in April and found out in November that it ran out in July. (I was used to paying rego for the old car in November so I thought i'd check how long i had to go) I was driving around unregistered for 4 months and honestly had no idea. Had to get a blue slip as it was out of rego for over 3 months.

Luck was on my side that year as i got pulled over for RBT a few weeks after i got it re-registered.
From memory the fine i was looking at was well over the $1000 mark in NSW

came back, 150 bux, 4 points (long weekend) and have a good night. drove off without any worries.

Ummm, i remember dad telling me years ago that he got done for driving his car unregistered when he let it slip over night but never got pulled over. Apparently one of the F3 Freeway monitoring cameras picked up his rego. Not 100% sure how true this is thou as a thought they were only to monitor conditions?

Or you get picked up on one of those numberplate recognition cameras that the cops were trialling here in NSW a few years back. Not sure if they hit WA though

They usually only did this on long weekends and school holidays. The thing that freaked them out the most was the amount of unregistereed cars on our roads. I have heard of quite a few people getting letter after getting snapped by them.

Driving unregistered isn't a hanging offence but if you hit and injure someone at the time you could be paying it off forever.

That might be the case. Ive regularly seen a little red flicker at night when im heading to port macquarie for new years etc.
Can they get cars for speed too (do they do trap times)
