that bloke ages ago who was trying to get his money back on the gts finally won. i think he was on here at one stage

A court has ordered Holden to repay a man who bought a faulty car. Now consumer groups say Australia needs 'lemon laws' to protect new car buyers.

If you buy a toaster and it doesn't work, the manufacturer will most likely replace it or refund your money. But when it comes to cars – the second-biggest purchase most of us will ever make – there's no law forcing the maker to replace or refund a defective vehicle.

But all that could change, thanks to Andrew Eggleston's landmark 'David and Goliath' court victory over car giant Holden.

The dream of owning a high-performance vehicle screamed to a halt for Mr Eggleston just months after he bought a HSV GTS in 2001. A litany of serious problems regularly kept it off the road and in for repairs, until his patience finally wore thin.

"There were times when I just felt like selling the car, but then it would have been on my conscience," Mr Eggleston said.

Holden decided the car wasn't safe enough for one of its engineers to test drive, but refused to replace it or refund Mr Eggleston's money – even when ordered to do so by the NSW Consumer Trader and Tenancy Tribunal.

Instead, Holden appealed to the Supreme Court. But it lost there, too.

"A car that's clearly documented as having a number of different defects, there should be no issue, there shouldn't have to be a fight," Mr Eggleston said. "It should just be addressed."

Holden has since repaid Mr Eggleston most of his purchase price. His case may now give some hope to others dealing with car companies over apparent lemons

any idea where this guy was from? ive seen a VX GTS getting around here (sutho shire) with a massive sticker across the back window reading "HOLDEN SHIT VEHICLE" and then some shit about "3 diffs....... 2 engines....."

there is an XR8 AU ute somewhere around sydney aswell with a massive yellow sign saying it is a lemon, he parks it outside the Ford dealerships :) good on him! and the bloke who won... big companies think they can push these problems under the carpet...

When i took my sv300 for warranty for the diff,while i was waiting for them to fit the diff i noticed this GTSright down the bottom,so i walked upto the car and started looking at it and said to myself "good lord wat da hells happened to this car" it was a total wreck,it looked like a 15yearold car,so i asked one off the guys there wat da hell has the owner done to this car ?
"he replied,its a lemon,everythings falling apart on it,which it was,and its in court the owner wants his money back.i mean i dont know how the guy was treating the car,but even the triming was falling apart,spoilers hanging off,paint faded on the 19's etc,it left me wondering,was the car built crap,or did the owner trash it ? :confused:

any idea where this guy was from? ive seen a VX GTS getting around here (sutho shire) with a massive sticker across the back window reading "HOLDEN SHIT VEHICLE" and then some shit about "3 diffs....... 2 engines....."
I've seen that dude too,parked out front of McGrath Holden at Kirrawee.
He must be really pissed off :mad:

mcgrath mmmm i havn't, strange and i only work near them. walk up at lunch time to see what they have once a week or so. nice balck cv8 up there buts its an auto..

probably explains it if he gets it serviced there, comes back worse after you put it in

what bothers me that guy went through 3 engines??? you can't be that unlucky to get 3 duds, something smells both ways, Another thing it is just about inpossible to go from a oil change to another without adding oil, maybe this guy refused to add the oil and let it run dry. what I would like to find out is how many of these Gen 111 have had to be fixed or replaced since introduced, also what about Clutches and P/Plates I've lost count how many have died.

well my case was also well documented but I just made em fix cause I loved the car so much

R8 went something like this
4 engines 3 diffs 1 gear box 1 steering rack 3 slave cylinders 2 seat bases etc etc etc

perfect not one warranty claim best built dammed car I have ever had

I must also say that if you treat the supplier with a moducum of decency they will always try to help Holden and HSV went out of their way to help way above my expectation

If you treat em rough I spose you get what you give and even though they lost the court case may be they are laughing at the angst and pay back they got to serve up to him until the end. petty cash to them

I have had 3 engines, 4 gearboxes, 3 diffs, and as the sticker said too many more too list priceless !!

I have had 3 engines, 4 gearboxes, 3 diffs, and as the sticker said too many more too list priceless !!

to save some time reading what up with the motors all burning or noisy ?

my cars had a motor, couple of diffs, power steer, well basically almost everything except the gearbox... however after the warrantee ran out not had any major probs, must be the great servicing they do.

no i think it's a fuel problem..... The dealer i go to now cannot work out what is wrong with the fuel. It's using 24 litres/100kms. So i think the prob with the engines is the fuel is going into the pistons which is causing it to chew the oil. i had a rebuild and block done in dec 04 and ive travelled 4500kms and the oil is a hairline off add. Its eating oil and fuel. im waiting for an engineer from holden to look at it monday cause the management system is saying everything ok

That dude is a miss dudette........and yes i am very pissed off.......and yes i parked it there for the week end....what pisses me off more is that everyone says to me what are you doing driving a car like that ??? can't females like big v8's as well ???? chicks can drive a porsche but not a v8 ???? do no females go to the formula one or v8's ????........so it all sounds like it comes down to gender now as to what type of car a women should drive.... I grew up watching my brother in law do up holdens...... holden was the car to own...now i never want to sit my backside in one ever again.....

Not in my book anyway. I saw a very nice looking Italian(?) girl driving a black Monaro a few months back and all I could do was smile because she looked so damn.... Anyway, regarding your story, not everyone has such terrible luck. I can tell you're really upset about what's happened but give it time. You could be on a BMW forum right now complaining about a dud M3 (http://members.roadfly.com/jason/m3engines.htm). Good luck with everything.

I'll think you find a lot of members on this forum have wives/girlfriend's/mum's/sisters/ect who own and drive V8's as well, myself included. A lady owning a VX GTS is :cool: ! No pandering or patronising, just fact.

Has anybody heard of the heat that gets in these cars. My legs burn from the heat that comes in the cabin and Holden say it's normal. I dont like air conditioning so i really feel the heat. Has anybody else noticed it ? My engineer was driving it and the heat off the foot pedal went through his thick leather sole shoes.

it does get somewhat warm from heat soak in traffic but not that warm.

i reckon your probs could be fix but not at holden, but i spose u don't want to pay to do properly. and shouldn't have to

Rather than pay an expert outside of Holden to fix it, are you able to get an expert's opinion on what could be causing the problems?

i have an independent engineer who has been real helpful. He is starting to think it is to do with the fuel consumption, fuel is going into the pistons causing the engine to chew the oil. i had a block and rebuild done in dec 04 and ive done approx 4800kms and the oil is a hairline off add. I went to fill it up today, empty light was on and could only get 48 litres into a 75 litre tank. if it's not one thing it's another. See what Holdens engineer says on monday

and NO,,,, NO men ask me out cause they think it's the hubbys car...... so i remain single hehehhehe

Ive been to an exhaust place and they are going to wrap the exhaust and manifold in heat tape they use on racing cars..... Cost $400, i'd rather pay it cause i cant stand my legs burning anymore. The dealer has felt how hot my legs get but Holden say its normal..... Ive actually begged them to do something about it and they wont. They say im sensative and it's the same in other cars, yet they wont demonstrate another car to me. They refuse.

wat have you done to that car kelly ? it looks like its been to hell and bak ? you should have got hpc coated headers as they keep the heat down,i have them in mine,i,m happy to let you do the leg test in mine :D

yeah but ive taken the sticker off now... there are alot of unhappy people out there..... everyone was yelling at me bout sticker....it was all good but got a bit embarrassing......it had to go..... glad i did it though i got alot of feedback....i even had a highway patrol car pull up beside me and say i know how u feel this is always in for the transmission and diff

It's a chick and thanks for your kind words...... it's a very rough ride fighting them especially when the car salesman is saying i got the shits cause he wouldnt sleep with me and thats when i started complaining about the car. The guy is a weazel i wouldnt sleep with him if he was the last man on earth. hes a scrawny runt and you could knock him out with 1 punch to the head... my pinky finger is probably thicker and longer then his dick. Is this what salesman resort to to win a legal case........ shes a single mum lets accuse her of sexual harrassment. I'd rather grow cob webs thanks...... this is about a car, but now it's in court it's about my sex life......... i think i could write a soapy by the end of this......... and those were the days of the vx gts life...
