Supercar driver wins fight for payout

RACING car driver Jason Richards has had his first win of the year – a District Court victory against his former team.
Race Driver Management, which represented the V8 Supercar driver, took legal action against Team Dynamik – SA's only V8 Supercar team – to recover more than $34,000 of withheld payments from the 2003 season.
Judge David Smith yesterday granted the three-time New Zealand touring car champion $41,704.44, plus interest.
Outside court, Mr Richards said that while he was "rapt" with the decision, he was disappointed about leaving SA.
"I am excited that justice has prevailed; people have to pay their bills," he said.
"I shifted myself and my partner from New Zealand and we thoroughly enjoyed it here and would have loved to have stayed.
"It could have been something everyone in Adelaide would have been proud of." The 29-year-old joined Team Dynamik for its inaugural year in January, 2003, and terminated his two-year contract after 12 months.
His management launched legal proceedings last year, to recover more than $30,000 in withheld payments from 2003 – monies that formed part of Mr Richards' $125,000 annual salary.
They also claimed he was entitled to 2.5 per cent of the gross merchandise sales and membership revenue for 2003.
Judge Smith yesterday agreed with these claims and granted Mr Richards $34,374.99 for the withheld monies and $7329.45 for merchandise and membership revenue.
He dismissed Team Dynamik's counter-claim for $720,000 to cover costs, including repairs to racing cars, future loss of profits and lost sponsorship.
At the trial yesterday, bankrupt former winemaker Andrew Garrett sought leave to appear for Team Dynamik. After lengthy legal argument, he withdrew his application and the matter proceeded without counsel for the defence.
Mr Richards, who is now based in Victoria, has been driving with the Tasman Motorsport team since he left Team Dynamik.
