View Full Version : Police HWP Records
Just a question for our local cops. 2 scenarios
1/ if you were caught 18km over the limit and let off with a stern warning to drive safely would that be recoded somewhere?
2/ if you were caught doing "30+ over the posted limit" and fined for "15Km over the posted limit" since the copper was in a good mood, would the initial 30+ be recorded in the HWP computer or something???
Thanks in advance
Robin
PS clean record in both cases with 1 prior speeding fine 8 years ago (10km over posted limit)
PPS hold the do you drive a v8 or 4cyl joke about the 1 speeding fine :burnout:

Tentatively i would say that:-
1. You were lucky and NO, it won't be recorded.
2. Again, lucky. He may have written up the ticket with the details of the detected speed in the evidence section, although it shows a reduced detected speed on your copy. Again also, it won't be recorded on a computer.
Cheers,
Macca

1. No, recorded in his notebook only unless there was some other reason for a record to be made that you may not be aware of, or he was particularly diligent.
2. No again, it is recorded as the 15km and under on the police computer and once paid/convicted, it is on your RTA driving record.
This advice is for NSW only though, not sure for other states. Hope this advice helps.

Whilst on the Police issue, and I'm sorry to stray from GenX's post but, Someone i know had an accident on the weekend, and the Police charged her with neg driving. At the scene, they took a statement and made her sign the note pad to say I was a true copy of what she said. Because it was am, and the fact it wasn't her car and the airbags went of she was a little startled, and now cant remember exactly what she said.
Firstly, from what i have been told, the Police are supposed to take a statement at the scene, and then take her to the station for another statement. Is this correct? Secondly, can she go to the station now and make a new statement, or can she amend the old one?
Thanks
James
Thanks for the info so-far guys....
I have checked the "short title of offence" section. It does have the actual speed detected, the speed zone speed (121Km/90Km) and then my offence "over 15Km"
If i write into infringement processing do they check the actual original and hence see that it was actually 31Km over posted limit? Or do they only know i was 15Km over posted limit.
I was about to pay the fine since the officer was a top bloke about the whole thing and let me off with a lighter fine. But then when i thought about it, i was pissed that i had a clean record and was caught going down the moony moony bridge hill on the F3 sydney bound, while on the brakes in the 90Km zone. So a letter is worth a shot but not if the infringement processing guys get a hold of the original. :shiner:

The officer would have made contemporaneous notes on the Part A of the infringement notice about the offence. You don't see this section as yours is a carbon copy except for this section. The only time you see what he has written is when it is tendered in evidence against you if you elect to fight it. I have rarely seen any notes on the infringement that are in the offenders favour as it's safest to assume every ticket written will go to court. In short, yes your detected speed will be seen.

Just like MACCA said, pay the fine and be done with it.....be thankful you still have your licence, you were done good by who ever pulled you up. If you start writing letters your might stir a pot that you don't want to......

Mate I understand your sentiments. I did say the officer was good about it, even when he fined me not once did I think what a wanker. BUT! they openly said that they gave me a reduced fine since they had me over what was on the lidar by the time i was half way down the mountain, and that they were checking my speed all the way down to the bottom of the mountain while i was slowly braking down to the speed he finally noted on the fine. And that’s the killer. He knew i was coasting down hill, he knew i started slowing down half way down yet he still fined me. Common, I did not have to tell him what I was doing, he knew exactly… what am I a habitual road menace or someone coasting down a hill at 2 in the morning?
Not a personal shot, I am more ajitated about the fine now that I had time to think about it.
But yah, as you said, I will probably pay the fine, just needed to vent a bit…

Rob youve done the right thing by venting in here. Venting your thoughts towards the copper who pulls you over is bound to end in tears. Trust me on that one!!!:D

I thought coasting was illegal anyway.
Dude, you were doing that speed in that zone, irrespective of what pedal your foot was on, the incline of the road, or any other irrelevant piece of information. You were given the lesser fine, so wear it and feel grateful to the cop.
