View Full Version : Hoon Legislation - They took my car!

First and foremost let me say i was in the wrong and i broke the law plain and simple. This thread is just about my experience, im not having a whinge.

So i left work on saturday afternoon after a morning shift at work and as a came out on to the main steet one of my co-workers was standing on the footpath giving me a wave so i thought i would 'say goodbye' and i reved the monaro right up and let the clutch out, making quite a bit of noise, and getting a little sideways. Next thing i know there is a cop RIGHT BEHIND ME and on the loudspeaker 'please pull over or suffer serious consequenses'. i pulled over on the next side street and after a long ordeal with questions like 'why where your wheels spinning?' and 'dont you think that is dangerous', which what really can i say, he told me under hoon legislation i have to have my car impounded for 48 hours. Well... gay. I still have my licence and i didnt lose and points and i didnt get a fine, but its just really really inconvienient. I get to pick it up tomorrow after work, i just hope they didnt go through and defect the crap out it, which im pretty sure they arent allowed to do. So thats my experience im now oficially a HOON :yup:

do you have to pay towing/holding fee's ?

mind you, the fact that you're a P plater probably persuaded him a lot more to pull you over.

that really sucks either way mate, these hoon laws are a bit of bullshit if you ask me.

from what i hear you have to pay towing and car impound fee and get a fine as well, i think its about a $800 cost but the time you have paid all these and second time caight they can impound your car for 3 months....

If you dont lose any points or get a fine then I'd say you were damn lucky! I'd rather have my car impounded for a couple of days then lose my licence and/or give my hard earned $$$ away.

So you think if there was no P plates on the car the cop would have just let him continue on his merry way? Rubbish.

The hoon laws are there for a reason and as Trip said he got caught fair and square. How is that bullshit???

In an incident early yesterday morning, police stopped two cars illegally racing on Pascoe Vale Road, at Meadow Heights, in Melbourne's north.

The vehicles were being driven at 140 kph in an 80 kph zone, and were seized for 48 hours under anti-hoon legislation.

The 38-year-old woman :confused: driver of one vehicle and a 33-year-old woman driving the other car are expected to be charged later.

The fact that he had a P Plate would have made absolutely no difference to the situation. You do a #11 in front of a copper and your car is gonna get impounded P plate or not.

Lucky nobody asked you.........

Was the offence "misuse of a motor vehicle"?

Here's a question, and probably a stupid one at that. Does the accumulation of hoon affences (ie 24hr, 3 mths, good-bye car) attach to the vehicle or driver? The reason I ask this is because of the following 2 situations.
1. Trip is taking his mates new ride out for a test, he suffers (:lol: ) from 'sustained loss of traction', sadly, in front of Mr Plod. Does old mate lose his car for 3 months because of Trip's priors?
2. Trip's car is being taken out by old mate, he suffers (:lol: ) from 'sustained loss of traction', again in front of Mr Plod, Does trip lose his car for 3 months because of the cars priors. If this is the case (that is the priors belong to the car, not the driver) can a car just be de-registered and then re-registered to mask it's 'driving history', or even transfer the rego to mum, dad, nana or whoever you realy trust, to avoid losing you ride?
I think I may have answered my own Q, it should be the driver, but is it?

The offences are associated with the driver, always.

So if in your scenario 1, its someone elses vehicle, he needs to make application to the courts to get it back.
Same goes for rentals etc. Have a look through the legislation its all covered in there.

Serves you right. Driving is a priviledge not a right and after being involved in several car accidents which were not my fault, I can honestly say that you have no idea the damage or distress a car accident can cause. Dont get me wrong I love my cars and V8's etc etc but if you want to hoon and smoke em up take it off the road and onto the tracks.

My son has learnt the hard way also Trip ,and I would think chops is right

My son was drag racing another car up a major highway here( I know, did I not teach him anything?) the car that egged him on was already being followed by an unmarked car they stopped the other guy and took his car and charged him and he was in court that week and lost his license for 6 months. The police went to my son's house and took his car and took him to the cop shop and then let him go and said we will get back to you , dont know what we will do yet???:confused: He got his car back 48 hours later. Anyway 6 or so months later :shock: he got a summons to appear in court and was fined $800 and lost his lic for 8 months and still has 15 days to go !!!
So it seems that it wont happen overnight but it will happen!!

And just ot , the guy he was racing , it was his second offence and only got 6 months and my son got 8 months for his first Go figure!!!???
I agree that he deserved it but consistency would be a good thing

Hope you get it sorted sooner rather than later

I love comments like this, might feel better going to sleep at night knowing that your one with the law and straight out good law abiding citizen because you know deep down you've never ever, spun your wheels.

Nearly every adult I know over 40 has at some point done a burnout, maybe they should have to give there current ride to the cops.

I think we should cut him a bit of slack seens as though he came on saying he was in the wrong rather than pin in on the cops or bullshit us.
