guys heading down the m4 towards the city some guy indicates to turn into my lane, he obviously did not see me, so i speed up to avoid being hit but at the same time i went over the speed limit...
I had a look to my left and see a station wagon parked on the side of the rd next to thos 000 emergency phones... I slowed down but i dont think i slowed down in time...
Question the car was parked normally, no flash went off nothing? Do u think i got booked?

Good chance, I've been done in a similar fashion. No use arguing either as they pull the old, why didn't you just jam on you brakes instead!
In their eyes they are much happier to see 10 cars emergency brake than one driver use.... dare I say it, commonsense and preform the unspeakable act of exceeding the speed limit for a few seconds.
You may have noticed I take issue with current speeding legislation.

You could dispute it if a fine comes, but I doubt you'd have much success. One argument (from their side) is that you could use the horn rather than the accelerator.....

If the flash did not activate on the camera car then you will not receive a fine. The flash activates when the camera is activated and takes a picture. That is a requirement of the legislation I believe.

Except when you get busted by a Non flash camera.

Having family members who up until recently retired from the local constabulary, i can tell you there are "flashless' cameras... Normally fines are processed within 6 weeks of infringement..
This is just an approximation i have been told.....

ok but this was whilst driving at night? Without a flash how can it capture my number plate?
Fines are usually posted within six weeks of infringment, however my old man got a fine 12 weeks after he got done by that famous speed camera in front of the schools in st george, any one from sydney will know the one.

was there any warning signs before or after the polic car? by law don't they have to display a sign either before on approach or after the stationary camera vehicle?

Yeah pretty sure they have to display one of those little blue'n'white signs "Speed Camera In Operation" or some such at the site. No sign, no worries.

And cause some innocent driver behind to run into his ass because of the other persons negligence.
Emergency braking could cause other accidents. Cops need to understand this rather than fill their revenue quota.
If there is a fine, request a copy of the photo. You never know what you may find.

No sign, no worries.
I wouldn't recommend you offer to pay his fine with a statement like that!
No offence to the thread starter, but I'd really challenge anyone to be positive that, when trying to avoid getting creamed by a truck, and suddenly spotting a speed camera, they actually know there was definitely no sign.
This thread has gone on long enough. You don't know until something comes in the mail or it doesn't, no matter what people say on here. Almost all your answers are going to be from people that don't like cameras, or don't like police, but it won't help you one bit!

too true, and yes that guy sits along the M4 on a regular basis because its a known fact that at this end of the freeway not many people stick to 110 - they cant be if their flying past me and I'm doing 112kph and its the easiest and safest way to start cracking down on speeding.
wait and see, I'm interested to see if you do recieve a fine or not especially seeing as no flash went off.
