Hi people I owe a stock vt ss gen 3.

Last night i have been booked for undue noise when I left a drive way Newcastle cbd, I had got the car upto the 40 Km speed limit and the copper had seen me do this from adistance, They had pulled me over to tell me that He is going to send the fine in the in the mail. It is going to cost me $300 and 3 points just think this is a completly stock gem 3 with no mods at all.

Do you think that iI can fight this fine????????

No I don't spin the wheels at all I am going to get a noise test done this morning to see what a stock gen 3 puts out.

I think that the coppers just won't to got more money :cussing: :cussing:

You can fight it if you want.
My first stop woudl be the local exhaust shop and have them check your dB levels.. Make sure it is all legit and within legal standards.

Also, where you giving it a good hiding or just cruising? Undue noise fines can come from Stereo systems as well not just exhaust note...

did you say the car is stock to him ?

check the rules, get a DB test then contest it.

PS not that this applies to you but i did read that for the next month police have a big crackdown on P platers happening due to the recent incidents.

The copper must've been having a bad day I reckon. He's scratching to ping a stock VTSS exhaust (with no leaks) for being too loud. Be sure to post the results of the test. Good luck.

I'd be more worried about the 3 points personally, i didn't think something like too loud would be a demerit point offense, just a defect???
Might have to put off the exhaust until i get my full license.

what dose the coppers these days have calibrated ears how the hell would he know if it was over the db limit stock gen3 sound like vaccum cleaners except there quiter contest it mate:cussing:

What fine ... don't worry about it, takes him 5 mins to write out the ticket there and then I think he may be just putting you on notice.

"Fine in the mail" usually means "No fine this time but take it easy" in my experience.

Problem is its not an EPA fine for noise...
Its an "Undue Noise" which is similar to a "Neg Driving" kinda thingy....
I cant see that what you have done is an issue, but just to be safe as i mentioned earlier, have the car dB tested at your local exhaust shop, and if you have only just rego'd the car and everything on it is legal, take ur Pink Slip... The car was deemed roadworthy......
Also, were you handed a fine on the spot?

No there was no on the spot fine because the copper said that he had another customer in the back off his highway patrol car :hmmm:


I have just rang to get a noise test done and machine operator had siad it depends on what the copper puts on the ticket :cussing: :cussing:

Undue noise doesnt have to be too loud an exhaust apparently, just booting it is ebough in any car.

Well thats what an article in The Mercury newspaper down here said, that any car can create undue noise...

plenty of noisier things around than a stock ls1, trucks, bikes etc

undue noise is not just your exhaust. i got done for undue noise+smoke last friday $240 + 0 points :D :D undue noise can be sound of tyres spinning as wel all know the odd slip 'o' clutch does the trick :)

Yeah and..... that was sort of my point. The article claimed that sticking the boot into it in anything could be deemed undue noise (i/e even grandma's corolla). While its stupid and not my point of view, it was relevent so thats why I mentioned it.

I wouldn't do anything until you get the fine in the mail and see what it's written up as. That's if you get a letter/fine at all.

You may be spending money on a db test for nothing. Put that money towards some mods like a Sureflow 3.5" system. hahahaha

I got this fine once however I'll admit to have been doing the wrong thing...I was fined for, and I quote "driving a vehicle in a way that creates UNNECESSARY noise".

that's a good point. there is absolutely no need to give a V8 a squirt to get it to 40km/h. getting to 40km/h in any manner quickly will create "undue" noise. You could have got to 40km/h 2 seconds slower, in a smoother fashion without the noise.

Not that i agree with the cops, but thats how they'd be looking at it.

You're lucky the coppa was nice and gave you the vesion of the fine without the word 'wilfully' in the title. :)

Thats what the last one I got was, same cost as "willfully create undue noise/smoke" but without the 3 points. ;)

Actually that is only partially true. The RTA funds certain operations, for example long weekend operations etc. The RTA fund the overtime bill etc when police work these dates.

Ain't that the truth. Sad really when it use to be top heavy with nice 8's. Although there is a very nice original monaro getting around most friday nights on the foreshore.

Thanks for the info Vulture. I always try to have neutral throttle as much as possible when and if I see em. Know mine would be pushin the limit ++ particularly in the 1-2000 RPM range - its an awesome growl but not sure the neighbours and coppas would appreciate it the way I do. Can feel it vibrate the upstairs floor at and can hear it anywhere in our house when the missus kicks it over.

Yes! Me too. I always feather the throttle when I see a Police car. I haven't had one sitting beside me at the lights yet but am a bit concerned they might not appreciate it. It is hardly offensive, though. I think the turbos will quieten it down a bit.

Hey Vulture what about puttin side pipes on it when ya get the turbos - a bit of flame out the side when ya hit it and the look on the copa's face should be an interseting sight (ha,ha):wave:

A dB test is pointless if you do end up getting fined.
As said above, it is purely a qualitative thing, judged by the cop at the time.
From experience I can say that this offense gets quite a bit of air play. It is one of those offenses that gets handed out when the cops cant legitimately find anything else to pin on you. The offense covers everything that you can do in a vehicle which results in generating more noise than is deemed necessary. I've been done for this one for a few things, ranging from chirping 3rd in my old gemini (those were the days), to using the horn (not in avoiding an imminent accident though ;) ), accelerating too quick, etc. The severity though seems to depend on the circumstances at the time, i.e. what mood the cop is in ....
