Got a question about insurance.

My mate had a accident on his motorbike the other day. An old guy pulled out of a driveway without looking and collected him.

The bike is totally rooted, his helmet is stuffed (he did a superman over the bonnet), and his mobile phone is smashed (he has a massive bruise on his leg from the mobile phone)

Now, the thing is - my mate did not have insurance - but the guy that hit him does. (I already belted my mate across the head for riding without insurance)

Will the old dudes insurance pay out if the bike is write-off? and if so - how will they determine the value?
Will the pay for a new helmet and mobile phone too?

Has the collision been reported to police and did your mate exchange details with the other party? I assume he was able to speak, etc, after the collision. If not, he should make some inquiries with the police who (were hopefully called and) attended.

As far as the insurance side of it goes, he isn't in a strong position, IF, the other bloke's insurance mob refuses to pay the costs of repairs, etc...

If I was in his position, I'd be looking at contacting the other bloke and obtaining his insurance details, then go from there.

Yeah - the accident was reported to the police.
My mate has the guys details, and knows he is with Austrlian Pensioners Insurance. He also has the details of 1 witness.

If possible then, speak to the other party and ask for an insurance claim number from him, then ring the insurance mob up with the details and hopefully they will come to the party.

In this situation, I probably wouldn't mention to them that I wasn't myself insured, unless they actually asked the direct question.

[/url]I've heard that uninsured drivers/riders are treated by insurance companies, much the same as drink drivers: that they are automatically considered at fault, and liable, no matter what the circumstances. I think you will find the old dude's insurance mob will say "No".
Your mate will find it nigh on impossible to get money out of them.
But... I might be wrong.

Went through the same type of accident myself last year. The other guy is in the wrong. Doesnt matter that your friend was uninsured. Get him to take the bike to a repairer. They should have the forms there for him to fill out. Tell him to ring the car drivers insurance company. If the bike is totalled he will have injuries. Tell him he must go to his doctor and get checked out. My injuries didnt relly surface for a day or two. Had whiplash and a sore back. The adrenaline rush you get masks the injuries for a while.
I had a long fight with the insurance company because I didnt report it to police straight away, and when I tried to they were less than interested. Took 6 months to get it all sorted. Ended up doing a google earth picture of the scene as well as finding the relevant section in the Australian Road Rules.
For those interested. A vehicle entering a roadway from a driveway has no right of way over anything.

Hope your friend not too hurt, and that things work out well for him.

Oh and they will pay him market value for the bike. If he takes it to a bike shop they will hopefully help convince the assessor that the bike was worth premium value.

shouldnt have a problem with it. other gus fault, claim through his insurance. call his insurance company and get a claim number, take it to a registered repairer, they will knock up a quote just make sure u tell them the claim number. i twiddled my thumbs for 2 weeks waiting only to realise i forgot to give them the bloody quote number
