    Yes its his insurance that is causing the problem. He's not paying because its a new business and he doesn't have the cash

    I feel like putting the car on a truck and bring it back to Brisbane. Pay someone to fix it and finish it

    You had full insurance ??- therefore your insurer should be sorting out your car repair & be chasing up the other party/parties for reimbursement. End of story.
    I assume you had your modifications included in your insurance cover ?? If not, then that could be an issue...

    Exactly, no if's, no but's, that is why we pay for insurance. When my Wife's car was hit by a runaway Hilux (dude left it in neutral with handbrake off) in the local shopping centre carpark a couple of years back the idiot decided he didn't want to play the game (actually tried to jump back in and drive off). I handed it over to Shannon's to deal with including his details which were obtained by a good citizen before he could drive off. Car which was not able to be driven was on a flat bed within 2 hours and off to be repaired. Shannon's chased up the other party through his insurer. Only issue for us was being without a car for a few weeks and no loan car due to him refusing to pay his excess.
    Hope it all works out for you mate, sounds like you are at the end of your tether.

    I would not expect the car to be (even registered, let alone) comprehensively insured as it had been off the road having "serious" modifications for 4 1/2 years..

    "Normal" comprehensive cover does not cover cars that are pulled apart or "laid up"

    & with this one in it would need to be insured on some sort of "highly modified" category with all the modifications listed

    & most likely on a "limited use" type of policy.

    I must say that if it was mine, I would not have been paying insurance for the car at this stage when it has not been getting driven

    & it would be extremely hard to get a cover on it as the build was being done anyway.

    Spot on Ed. Not my insurance issue. The car is in care of the Shop. So it's the shop insurance. And I have maintained comprehensive insurance during the 4 and a half years (as well as rego). And the insurance cover is for the original car.

    I'm really surprised the shop insurance is willing to cover you. I was told by the shop that had my car when it was damaged under the same sort of circumstances that they had legal advice that they weren't liable, and my insurance company said the same. Unless, the shop has decided to put it through as their fault, I guess.

    Normally, you would just give the details of the other party to your insurance company, they deem them at fault, and your car gets fixed. Doesn't matter if the other party doesn't want to pay, your car gets fixed no matter what, as the insurance company pays and recovers the money themselves. This sounds more like the guy is not actually insured or the shop is dealing with the other party directly?

    When you say the insurance is for the original car, what does that mean? You are paying for insurance for a car that no longer exists? Sorry, I am confused.

    I could however see that if an assessor came out and looked at the car that they might query the claim due to the amount of mods if they are not disclosed and on your policy.

    I could be mistaken but I think he is saying that the car was still insured as 100% stock

    & his insurance company took a look at the car & noticing the extensive modifications they refused to pay the claim.

    Not that it helps now.. but I moved to Enthusiast Insurance for that reason, laid up, mods etc getting modified etc.

    It was also pennies on the dollar compared to regular comprehensive because the car wasn't being driven.
